Cosmetics: upcoming regulatory deadlines

Cosmetic companies must ensure compliance of their products over time. To do that, it is essential to remain ahead of regulatory changes.

Below is a list of upcoming regulatory deadlines that cosmetic manufacturers must be aware

EU

In the European Union, the European Commission lowered to 10 ppm the threshold for adding the warning “releases formaldehyde” on the labels of products containing preservatives releasing formaldehyde. The new labelling requirement applies as of 31 July 2024 for new products to be placed on the EU market. Companies have time until 31 July 2026 to conform to the new requirement for cosmetics that are already on the market.

Furthermore, on 15 March 2024, the European Commission published a new Regulation establishing the ban on several nanomaterials and restricting the use of Hydroxyapatite (nano). Timelines to comply are 1 February 2025 for placing on the market cosmetic products and 1 November 2025 for making them available on the market.

UK

Regarding the United Kingdom, as of 6 July 2024, only products compliant with the latest restrictions for Methyl-N-methylanthranilate (M-N-MA) can be placed on the UK market. Afterwards, products not compliant with these restrictions must be sold or recalled from the UK market before 6 July 2026. The updated regulatory status of M-N-MA is an example of how the UK aligns with EU decisions after Brexit.

US

In the United States, some of the MoCRA requirements start applying in summer 2024. In this sense, facilities manufacturing or processing cosmetic products for the US market must register with the FDA by 1 July 2024. By the same date, companies must perform the product listing of cosmetics sold in the United States. This is linked to the FDA announcement that they will not enforce MoCRA requirements on facility registration and product listing until end of June 2024 to give the industry more time to comply.

Lastly, by 29 December 2024, cosmetic products must include contact information for adverse events reporting on labels. Contact information can be a US address, US phone number, or electronic contact information, such as an email or a website (whether foreign or domestic).
