Regulation (EU) 2016/1628 – Pollutant limits in non-road machinery

The Regulation (EU) 2016/1628, approved on September 14th 2016, introduces the requirements relating to gaseous and particulate pollutant emission limits and type-approval for internal combustion engines for non-road mobile machinery, as well as the requirements relating to EU type-approval.

The European Union wants to tackle with this new Regulation the importance of clear rules to improve air quality for workers and citizens in general, without prejudice of the competitiveness of markets and manufacturers.

What kind of products can be affected by this Regulation?

The non-road mobile machinery is any mobile machine, transportable equipment or vehicle not intended for the transport of passengers or goods on roads. However, the machinery installed on the chassis of vehicles intended for the transport of passengers or goods on roads are included.

Emissions from the engines of this kind of machinery constitute a significant proportion of the total man-made emissions of certain noxious atmospheric pollutants, as carbon monoxide (CO), total hydrocarbons (HC) and oxides of nitrogen (NOx).

I am non-European manufacturer of non-road mobile machinery. Do I need an European Authorized Representative (EAR) for this Regulation?

No, you don´t need an EAR to comply with this regulation. However, this document legislates only the pollution emitted for this kind of machinery. All machinery products must comply with the Directive 2006/42/EC and therefore you need an EAR as one of its requirements.
