The EU Cosmetics Regulation establishes that only products for which a legal or natural person is designated within the European Union as Responsible Person (RP) can be placed on the market. Moreover, the Regulation provides that:
- Companies based in the EU are their own RP;
- For companies based outside the EU, the RP is the importer.
Nevertheless, the law grants the RP (namely, the EU brand owner or the importer) the possibility to appoint by written mandate another entity as Responsible Person. This allows companies to designate a professional RP to take over its responsibilities, such as ensuring compliance against regulatory requirements and keeping the manufacturer updated on regulatory changes. The agreement through which another entity is appointed as Responsible Person is the RP Mandate.
This is the reason why, at Obelis, we ask our non-EU clients to share with us their importers’ details. We need to reach them and sign an RP Mandate to release them from the role that would otherwise be theirs by law. Evidently, the service agreement signed between Obelis and a brand owner does not cover this aspect.
It is in the interest of all parties to sign an RP Mandate. The importer is relieved of the RP’s responsibilities, and the brand owner does not have to share with them all the technical and proprietary information, such as ingredient concentrations.
