Appointing A European Authorized Representative

Crucial points to consider in appointing your “European Authorized Representative”:

Your E.A.R.has the responsibility to observe the manufacturer’s compliance with the conformity assessment procedure set out in the European Directive which applies to the product.
Your E.A.R is there for vigilance intervention; to handle and file the instance of any and all complaints and claims in regard to the manufactured product.
The “European Authorized Representative” (E.A.R.) CANNOT simply be a POST OFFICE BOX but must be a registered place of business located within a European member states, or the European free trade area.
The manufacturer needs a specialized & professional company as an E.A.R.

Manufacturers are encouraged NOT to use one of their European Distributors as their E.A.R., even if the Distributor offers this service for FREE.

REMEMBER:

A European Authorized Representative will be responsible to observe the manufacturer’s compliance with the conformity assessment procedure described in the European Directive for the product. - Are you comfortable having your distributor measure this compliance?
Your European Authorized Representative must understand all EU regulations from each of the 25 EU member states EFTA.
A European Authorized Representative must keep the product"Technical File” available at any time for the EU member states authorities. - Do you do not want a distributor to have your “Technical File”?
As a manufacturer distributing in more then one EU country, your appointed European Authorized Representative would be aware of incidents in areas he is not responsible for. - Do you want a distributor to be aware of such incidents that will affect the way he/she handle’s your product?
A European Authorized Representative will handle the manufacturer’s sensitive product information, trade secrets, European market information,distributor lists etc. - Do you want a distributor handling your confidential production information while potentially handling competitor products?
Appointing a Distributor may require him to make decisions contrary to his/her own interest and/or to your International sales objectives.
It will be costly for you to change a distributor acting as a european authorized representative products carrying the distributor’s/european authorized representative’s name on all labeling, catalogs, instruction sheets, and packaging will be on the EU market long after the distributor has changed.
A European Authorized Representative must remain NEUTRAL in all actions and responsibilities towards all European Competent Authorities.
