The European Parliament published on the 9th of March 2011 the Construction Products Regulation (CPR 305/2011/EU) which is to repeal the CPD 89/106/EEC Directive. Although most of the provisions of the Regulation have already taken effect, articles 3 to 28, 36 to 38, 56 to 63, 65, 66, and annexes I, II, III, and V will be enforced starting 1st of July 2013.
The new Regulation proposes tougher rules on the construction industry, unifies member states’ position on the industry and intends to improve three important areas regarding:
With regard to the scope of the CPR 305/2011/EU, the Regulation defines what a construction product is and allows for 35 areas of classification for a construction work. All products are to be classified into one of the classifications and tested based on the requirements of each classification.
Concerning the requirement for manufacturers to comply with the CPR 305/2011/EU, the Regulation clearly states seven basic conditions that need to be followed:
Furthermore, the new Construction Products Regulation describes the necessary measures to be taken for compliance tests, the roles of the notified bodies and that of Technical Assessment Bodies (TABS), which are required for products that do not already fall into pre-existing standards or only partially fall into the scope of a standard.
Also the text refers to the declaration of performance that the manufacturers need to draft and which will include detailed information about the product, about the manufacturer and the European Authorized Representative.
